terms of service

these are the terms of service that you will agree to when commissioning me for digital artwork or owning one of my designs. by commissioning me, you are agreeing that you have read, understood and agreed to the following terms. if there is anything that you don't understand - please feel free to reach out to me for clarification! ♡

general terms

• i reserve the right to decline any commission for any reason.• full payment must be sent before i start working on your commission.• i only accept payment through paypal. all payments are to be sent through the 'goods and services' option.• as the artist, i retain all rights to my commissioned works. this means that i retain the right to publish, share, distribute and use in advertising of my work.• nobody is authorised to copy, trace, alter or otherwise make use of my artworks. commissioners are allowed to use their own commissioned pieces for personal use (eg. profile pictures, banners, wallpaper, storage, etc.) with credit to me as the artist. commercial use is prohibited and not currently offered.• an example of acceptable credit would be something that links back to me as the original artist, such as @kitsuwn or a direct link like toyhou.se/kitsuwn or kitsuwn.carrd.co.• please allow up to 2 months for me to complete your commission. in most cases it will not take me that long to finish your commission, however, i reserve this term in case of an emergency situation. because of this, i will not be taking on any commissions that must be completed by a certain time frame.• nobody (including commissioners) has the right to mint my artwork as an nft (non fungible token) under any circumstances. this includes using my artwork to feed an ai generated software or website.

design terms

• as the designer, i retain all intellectual rights and copyrights over the design. when you obtain a design from me, you are obtaining the rights for personal use only.• you may not resell my designs for more than what you paid for them - unless additional value has been added to them (eg. artwork created by you or others). artwork received through trades or as gifts do not add additional value.• characters that are received through gifts or giveaways are not to be resold - only traded or given as gifts.• you may slightly alter my designs as long as the character doesn't become unrecognisable from the original. even after changes, credit to me as the original creator must stay the same.• you may add minor edits over the original artwork of the design. the original file must remain on toyhou.se, but may be hidden from others if desired.• creating siblings based off my designs or breeding my designs to create litters is prohibited.• all of my designs must remain on toyhou.se - even if they are sold off-site. this is primarily for record keeping and proof of ownership. i can provide a toyhou.se code at no extra cost to buyers without an account.• i reserve the right to revoke and resell or repurpose a design if payment isn't received or a chargeback is initiated.

refund policy

• refunds are not permitted once i have started your commission, unless for whatever reason i am unable to complete it. in that case, a full refund will be provided.• you are allowed to request a refund if i have not yet started working on your commission. once a sketch has been sent for approval, all grounds for a refund on your behalf are voided.• chargebacks are not allowed under any circumstances. if a chargeback is initiated, you will no longer have ownership over the artwork and you will be blacklisted from commissioning me in the future.
